Do I need permission to advertise?

The display of advertisements is controlled through a specific and independent approval process commonly known as ‘advertisement consent’. It ensures that advertisements comply with planning regulations and do not have a negative impact on the local environment, public safety, or amenity. ‘Advertisements’ are broadly defined but includes posters, billboards, digital screens, banners, projecting signs, pole signs and directional signage.

There are three types of advertisement consent and depending on which category the advertisement falls within, will determine whether consent from the local authority is required. These include:

  • Advertisements outside of the local authority’s control - on a car, within a shopping centre or music venue etc.

  • Advertisements which have deemed consent – where certain limits and conditions can be met (such as size, location and type of illumination).

  • Advertisements which need express consent – those which do not fall within the above categories and therefore an application to the local authority is required.

It should be noted that a separate planning permission is not required in addition to advertisement consent, however express consent must be applied for and obtained from the local planning authority if applicable.

An application for express consent will be assessed on its impact on amenity, public safety, visual impact and highway safety.
